Services

Vache Edward Bahadurian, Esq. is an experienced and effective defense lawyer based in New Jersey.  He represents clients with the following types of cases: DWI and DUI, Breath Test Refusal, Criminal Defense, Juvenile Delinquency, Expungements, Traffic Tickets, and DMV Hearings.

  • DWI and DUI

Driving while intoxicated (DWI) and driving under the influence (DUI) cases begin with an arrest by the police for driving a motor vehicle while under the influence of alcohol and/or drugs.  These arrests for impaired driving or drunk driving sometimes result in an accusation that the driver failed to take the required breath test, either the Breathalyzer or the Alcotest.  These charges are filed in municipal court and the police commonly write DWI or Refusal on the front of the ticket or summons.  The potential penalties and consequences associated with DWI, DUI, and Breath Test Refusal cases include jail, driver's license suspension, ignition interlock device, large fines, community service, hefty surcharges, plus problems with work, commercial driver's license (CDL), and car insurance.  These are serious charges which deserve an experienced DWI lawyer to analyze the facts and evidence of the case.

Mr. Bahadurian is an experienced DWI defense lawyer.  He carefully reviews all of the police reports and records in order to find any mistakes or errors, violations of rights, and develop potential defenses.  There are specific items of evidence and proof the prosecutor is required by law to disclose to the defense and then substantiate in court.  For example, the police must have a proper legal reason to stop and arrest the driver.  Also, if a breath test is given to the driver, the police must test and operate the machine according to the official procedure.  Since there are numerous variables, there are many potential defenses.  The prosecutor is required to prove each and every element of the law beyond a reasonable doubt.  Therefore, if only one of the required elements of proof is weak or nonexistent, the defense may be successful.

  • Criminal Defense

Criminal cases usually involve an investigation and an arrest by the police with an accusation that a misdemeanor offense or felony crime was committed by an adult.  Common examples of misdemeanor offenses are possession of drugs - marijuana or drug paraphernalia, use or being under influence of controlled dangerous substance, certain theft offenses, shoplifting, disorderly conduct, improper behavior, certain bad checks, simple assault, resisting arrest, eluding police officer, harassment, criminal mischief, criminal trespass, unlicensed entry of structure, and defiant trespass.  In New Jersey, misdemeanors are referred to as disorderly persons offenses or petty disorderly persons offenses and the accusations are filed in municipal court.  The potential penalties and consequences can be serious, such as jail, large fines, suspended license, probation, community service, surcharges, restitution to the victim, immigration problems, and employment issues.  Mr. Bahadurian is an experienced criminal defense lawyer.  He meets with the client, interviews any witnesses, reviews all of the police reports and records in order to prepare and present a persuasive defense.

  • Juvenile Delinquency

Juvenile delinquency cases refer to criminal accusations against a minor child or youth.  In New Jersey, juvenile cases are filed in the family court alleging that a criminal related offense or violation was committed by a person under the age of 18.  The specific accusations or charges are listed on the juvenile delinquency complaint which is given to the parent or guardian by the police.  The potential penalties and consequences of juvenile delinquency may be serious, such as youth detention, probation, community service, suspended driver's license, surcharges, restitution, plus problems with school, college admission, and future career.  Mr. Bahadurian is an experienced juvenile lawyer.  He meets with the client and parent or guardian, interviews any witnesses, reviews the police reports and records in order to prepare and present a pursuasive defense.

  • Expungements

An expungement is the legal process to erase and remove all criminal records on file within any court, police department, prosecutor's office, probation department, and sheriff's department concerning a person's arrest, conviction or dismissal of an offense within the criminal justice system or juvenile justice system.  Mr. Bahadurian is an experienced expungment lawyer.  Clients typically want to clear and expunge criminal records involving an adult arrest, juvenile records, felony arrests, misdemeanor arrests, disorderly persons offenses, petty disorderly person offense, criminal charges, criminal convictions, crimes, offenses, deferred dispositions, dismissals, dismissed cases, pretrial intervention program records, PTI records, and Conditional Discharge records.  Mr. Bahadurian will first determine if the criminal record can be erased, cleared, sealed, removed, and expunged under the law.  The expungement process may be an important tool for a person to obtain a job since a criminal record may prevent an employer from wanting to hire an otherwise qualified applicant.  When an order for expungement is granted, the arrest, conviction or dismissal, adjudication of juvenile delinquency, disposition, and any related proceedings are considered not to have occurred.  The purpose of an expungement is to give a person a “fresh start.”

  • Traffic Tickets

Common traffic tickets include Speeding, Reckless Driving, Careless Driving, racing on the highway, hit and run car accident, Leaving the Scene of an Accident, failure to report an accident, Driving Without Insurance, no insurance, uninsured car, driving on a suspended driver's license, Driving with a Suspended License, driving with a revoked driver's license, Unlicensed Driver, driving without a valid driver's license, no license, Overweight Vehicle, Commercial Vehicle Violations, overweight truck, improper passing of a school bus, Tailgating, following too closely, Improper Passing, illegal u-turn, improper turn, driving ticket for going the wrong way on a one way street, failure to turn, Failure to Observe Signal, failure to observe a traffic control device, failure to observe a traffic light, going through or running a red light, failure to observe stop sign or yield sign, Failure to Stop or Yield, failure to maintain lane, failure to signal, unsafe lane change, improper lane change, red light violation, and stop sign violation.  Traffic tickets and summonses are filed in municipal court.  Some traffic violations carry significant penalties and consequences, such as points on driver's license, fines, suspended license, surcharges, problems with auto insurance, driver's license, CDL, and job.  Mr. Bahadurian is an experienced traffic ticket lawyer.  He meets with the client, interviews any witnesses, and reviews the charges, driving record, police reports and records in order to prepare and present a persuasive defense.

  • DMV Hearings

DMV cases usually involve driver's license suspension issues and suspended license problems, which are resolved at a department of motor vehicles hearing.  In New Jersey, these hearings are held at the motor vehicle commission offices throughout the State.  Mr. Bahadurian has many years of experience as a DMV lawyer fighting for the rights of drivers against the DMV and the State of New Jersey.  He will meet with the client and review the driving record in order to prepare and present a persuasive defense to prevent, avoid, eliminate, or reduce a driver’s license suspension.
